Prop 65 Warnings on Lighting: Why the Label Is on the Box

A warning label on a lamp carton alarms customers and confuses buyers, and the reason it appears on so many products in so many categories has less to do with the hazard than with the way the regulation works.

How the requirement functions

California maintains a list of chemicals known to cause cancer or reproductive harm and requires businesses to provide a clear and reasonable warning before exposing consumers to them, unless the exposure falls below an established threshold or the business can demonstrate that no exposure occurs. Enforcement is driven by private litigation, which is why warnings appear where the exposure question has not been formally resolved.

Where lighting products meet it

Common areas of exposure in lamps and fixtures:

• Plated or painted metal parts, where residual chemicals may be present
• Cord and plug components, particularly PVC insulation stabilised with lead compounds
• Solder and brass components
• Packaging inks and coatings

A label is not a defect

A warning reflects the outcome of a risk assessment rather than a product flaw. It does not replace the safety listing and it is not evidence that the product is non-compliant. Retailers sometimes treat it as a reason to reject a product, which confuses two entirely separate obligations.

What buyers should ask a supplier for

Three items, in writing, and they should agree with each other:

1. Whether a warning is required for the product as configured for sale into California
2. The basis for that decision: testing, supplier declarations, or a threshold assessment
3. The exact label text and its placement, on the product or on the packaging

Keep the file

Whatever the conclusion, record it and keep the supporting evidence for as long as the product is sold. The value of a documented assessment is that it can be produced later, when the product is three years old and nobody remembers the reasoning.
